White Commercial Responds to Cherwell District Council’s Designation for Major Planning Applications
18 June 2026
White Commercial Surveyors has responded to the Government’s designation of Cherwell District Council under Section 62A of the Town and Country Planning Act 1990, describing the decision as one of the most significant planning announcements affecting major Commercial and Residential development in North Oxfordshire for many years.
The designation, which came into force at 9.00am on 15 June 2026, means that applicants for major residential and commercial development in Cherwell now have the option of submitting planning applications directly to the Secretary of State through the Planning Inspectorate, rather than only through Cherwell District Council.
The measure does not remove Cherwell District Council’s role as the Local Planning Authority. However, it gives developers, landowners and investors an alternative route for major applications where confidence in timescales, decision-making and delivery is critical.
White Commercial Surveyors, based in Banbury – on the London to Birmingham M40, has been involved in the majority of large-scale commercial development activity in Cherwell and along the northern M40 corridor since the extension of the London to Birmingham M40 in the early 1990s. The firm has advised landowners, occupiers, developers and investors on major employment, industrial, logistics, office and mixed-use development opportunities across Banbury, Bicester, Junctions 9, 10 and 11 of the M40, Upper Heyford and the wider North Oxfordshire and South Northamptonshire region.
The designation is a clear reputational challenge for Cherwell District Council and reflects Government concerns about the quality of decision-making on major planning applications. It also comes at a critical time, as Cherwell progresses its Local Plan Review to 2042 and seeks to balance housing growth, employment land, infrastructure, environmental protection and sustainable economic development.
From a development and commercial property perspective, the announcement could have far-reaching implications. Major commercial and residential schemes have often faced lengthy and uncertain planning processes, and the ability to submit directly to the Planning Inspectorate may be viewed positively by developers, occupiers, investors and landowners seeking greater certainty.
White Commercial believes the designation may help unlock confidence in strategic employment and residential sites, particularly around Banbury, Bicester, Upper Heyford and the M40 corridor, where demand from occupiers, logistics operators, advanced manufacturing, technology, science, and automotive-related businesses remains strong.
The potential benefits include faster progression of major schemes, improved certainty for investors, reduced planning delay, and greater confidence for businesses considering expansion or relocation within Cherwell. However, the firm also recognises the importance of local democratic input and the need for communities to remain fully engaged in major planning decisions.
Chris White, Managing Director of White Commercial Surveyors, said:
“Cherwell’s designation under Section 62A is a serious matter and should not be underestimated. It is clearly a critical moment for the Council and for the development industry in Oxfordshire.
“However, this should not be seen as a negative statement about Cherwell’s economic future. Quite the opposite. Cherwell remains one of the most strategically important commercial property locations in the UK, sitting on the London to Birmingham M40 and Oxford Cambridge corridor, with excellent links to Oxford, Birmingham, the Midlands, London and the wider South East.
“Since the M40 transformed the economic geography of North Oxfordshire, White Commercial has been closely involved in the majority of large-scale commercial development activity across the district. We have seen first-hand how Banbury, Bicester and the wider Cherwell area have attracted occupiers, investors and developers because of the district’s connectivity, workforce, land supply and commercial ambition.
“The concern for the development industry has often been uncertainty, delay and the cost of prolonged planning processes. If this designation introduces greater clarity and encourages timely decisions on well-considered, sustainable development, then it could help unlock investment, employment and regeneration.
“Cherwell District Council now has the opportunity to respond positively, improve performance, rebuild confidence and work constructively with the private sector. The district needs strong planning leadership, but it also needs the confidence of developers, occupiers and investors who are prepared to commit capital, create jobs and deliver high-quality development.
“Our view remains positive. Cherwell has all the ingredients for continued economic growth, particularly in industrial, logistics, technology, automotive, science, office and mixed-use development. The key now is to ensure that the planning process supports that growth, rather than constraining it.”
White Commercial considers the designation to be a procedural change rather than a barrier to development. For landowners and developers promoting major residential, commercial, logistics or mixed-use schemes, it provides an additional route to determination and may reduce perceived planning risk.
The announcement is likely to increase interest in major sites around Banbury, Bicester, Upper Heyford and the M40 corridor, particularly from regional and national developers seeking certainty in a competitive market.
White Commercial believes the district’s long-term prospects remain strong, provided planning, infrastructure and economic development policy are aligned to support sustainable growth, employment creation and high-quality development.
